Your location is where licensing gets real, and where expensive mistakes happen. Texas Transportation Code §503.032 calls it an "established and permanent place of business." TxDMV's rules (43 TAC §215.140) add detail.
Ownership or lease
You must own the property or have a written lease with a term at least as long as your license term.
A permanent furnished office
The office must be equipped for selling the vehicle type you're licensed for. TxDMV's guide covers office structure, equipment and sharing space with other dealers.
A conspicuous sign
Your business name in letters at least six inches high.
Display space (retail)
Room to display at least five vehicles of the type in your application. Wholesale applicants are exempt from this one.
Being there
You or a bona fide employee must be at the location and available to the public or TxDMV during reasonable business hours. TxDMV rules also address posted hours and appointment-only operation.
Pre-lease checklist
- Can the lease run at least the license term?
- Is there a real, enclosed office you can furnish?
- Can you mount a sign with six-inch letters?
- Is there display space for five vehicles (retail)?
- Does local zoning allow vehicle sales here?
- Will the landlord allow your signage and use?
